A Loitoktok court has jailed an incestuous father for 30 years for defiling his 11– year- old daughter.
Peter Mungala who was convicted and subsequently jailed by Resident Magistrate Nelson Njuguna committed the serious offense on December 22, 2023 at Masimba area, Poka location, Kajiado County.
During the trial the minor had told the court how her father used to visit their house where she lives with her brothers and defile her after her mother ran away over a disagreement.
She said on the material day the convict who lived in a nearby separate house took her to his house where he undressed and defiled her after which he gave her Sh20 to buy mandazis.
The minor informed her mother what her father had done to her and the matter was reported at Masimba police station following which Mungala was arrested and the girl escorted to nearby health centre for medical examination which confirmed a history of defilement.
He however pleaded not guilty claiming his wife had run away with all the children and it was impossible to have defiled the minor while she was with her mother.
The court however dismissed Mungala’s defense as an afterthought arguing he never raised such an issue earlier during the proceedings.
RM Njuguna further found the prosecution had proved the case beyond any reasonable doubt hence the lengthy sentence.
The accused has 14 days to appeal against the sentence.
