A Kabarnet court adjourns a robbery case due to lack of mandatory exhibit

A robbery with violence case has been postponed three times in row by a Kabarnet court after the prosecution failed to present crucial exhibits.

The prosecution counsel Rebecca Bartilol was supposed to prove a case against Dennis Ayabei by presenting to the court copies of critical medical reports from the hospital that treated the complainant.

Ayabei had been charged that on May 21, 2023 at around 11am jointly with other unidentified accomplices not before court allegedly attacked and robbed Hillary Chepkonga at Kapkombe village within Saimo location of Baringo North sub-county.

The accused are reported to have violently robbed the complainant of Sh 85,000 and a mobile phone valued at Sh 1,500 and left him with injuries.

The accused charged with robbery with violence contrary to Section 296 (2) of the Penal Code denied committing the offence before Senior Resident Magistrate (SRM) Edwin Mulochi.

Ruling, SRM Mulochi ordered the case to be adjourned to June 24 to allow the prosecution time to secure and present the required documents.

The defence agreed with the decision stating that it should be the last adjournment since it was the third time the case was adjourned due to failure on the part of the prosecution.
